Terms of Service

Article 1 Purpose
  1. The purpose of these Terms is to stipulate the rights, obligations, and responsibilities of the site and users regarding the use of internet-related services (hereinafter referred to as "Services") provided by this site (hereinafter referred to as "BlueL").
Article 2 Definitions
  1. "BlueL" refers to a virtual place of business set up to enable users to trade goods or services (hereinafter referred to as "Goods, etc.") using computers and other information and communication equipment, and it is also used to refer to the business operator running the cyber mall.
  2. "User" refers to both members and non-members who access "BlueL" and receive the services provided by "BlueL" according to these Terms.
  3. "Member" refers to a person who has registered as a member by providing personal information to "BlueL" and who continuously receives information from "BlueL" and can continuously use the services provided by "BlueL".
  4. "Non-member" refers to a person who uses the services provided by "BlueL" without registering as a member.
Article 3 Specification, Explanation, and Amendment of Terms
  1. "BlueL" shall display these Terms, business name, representative’s name, business address (including the address where consumers can file complaints), phone number, fax number, email address, business registration number, e-commerce registration number, and personal information manager on the initial service screen (front page) of the site so that users can easily find them. However, the content of the Terms can be viewed by users through a connected screen.
  2. "BlueL" must provide a separate linked screen or pop-up screen to ensure that users can understand important contents such as withdrawal of subscription, delivery responsibilities, and refund conditions before users agree to the Terms.
  3. "BlueL" may amend these Terms within the scope of not violating related laws such as the Act on Consumer Protection in Electronic Commerce, the Regulation of Standardized Contracts Act, the Basic Act on Electronic Commerce, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Door-to-Door Sales Act, and the Consumer Protection Act.
  4. When "BlueL" amends the Terms, the effective date and reasons for amendment shall be specified and announced along with the current Terms on the initial screen of the site from 7 days before the effective date to the day before the effective date. However, if the amendments are unfavorable to users, at least a 30-day grace period shall be provided for notification. In this case, "BlueL" shall clearly compare the contents before and after the amendment to make it easy for users to understand.
  5. When "BlueL" amends the Terms, the amended Terms apply only to contracts concluded after the effective date, and the provisions of the Terms before amendment apply to contracts already concluded. However, if a user who has already entered into a contract wishes to apply the amended Terms, the user can request it within the notice period of the amended Terms under Paragraph 3, and if "BlueL" agrees, the amended Terms will apply.
  6. Matters not stipulated in these Terms and the interpretation of these Terms shall follow the Act on Consumer Protection in Electronic Commerce, the Regulation of Standardized Contracts Act, the Consumer Protection Guidelines in Electronic Commerce set by the Fair Trade Commission, and related laws or customary practices.
Article 4 Provision and Change of Services
  1. "BlueL" performs the following tasks:
    1. Providing information on goods or services and concluding purchase contracts
    2. Delivery of goods or services for which a purchase contract has been concluded
    3. Other tasks determined by "BlueL"
  2. "BlueL" may change the contents of the goods or services to be provided in future contracts in case of sold-out goods or changes in technical specifications. In this case, the changed contents and the date of provision shall be specified and immediately notified at the place where the current goods or services are posted.
  3. If "BlueL" changes the contents of the services for which a contract has been concluded with the user due to reasons such as sold-out goods or changes in technical specifications, the reason shall be immediately notified to the user at an address where the user can be reached.
  4. In the case of the preceding paragraph, "BlueL" shall compensate the user for damages caused by this. However, this does not apply if "BlueL" proves that there was no intention or negligence.
Article 5 Suspension of Service
  1. "BlueL" may temporarily suspend the provision of services in case of reasons such as maintenance, replacement, or malfunction of information and communication equipment like computers, or interruption of communication.
  2. "BlueL" shall compensate users or third parties for damages caused by the temporary suspension of service provision for reasons stated in Paragraph 1. However, this does not apply if "BlueL" proves that there was no intention or negligence.
  3. If the service cannot be provided due to reasons such as business transition, abandonment of business, or integration between companies, "BlueL" shall notify the users as stipulated in Article 8 and compensate consumers according to the conditions originally presented by "BlueL". However, if "BlueL" has not notified the compensation criteria, users' mileage or points shall be paid in cash or in kind equivalent to the currency value used at "BlueL".
Article 6 Membership Registration
  1. Users apply for membership by filling out member information according to the registration form set by "BlueL" and expressing their consent to these Terms.
  2. "BlueL" registers users who have applied for membership as stated in Paragraph 1 as members, unless they fall under any of the following:
    1. If the applicant has previously lost membership under Article 7, Paragraph 3 of these Terms, except in cases where 3 years have elapsed since the loss of membership under Article 7, Paragraph 3 and the applicant has obtained consent for re-registration from "BlueL".
    2. If there are false, missing, or incorrect entries in the registration information
    3. If registering as a member significantly hinders the technical aspects of "BlueL"
  3. The time of establishment of the membership contract shall be when "BlueL"'s acceptance reaches the member.
  4. If there are any changes to the registered information, the member shall immediately notify "BlueL" of the changes by email or other means.
Article 7 Withdrawal and Loss of Membership
  1. Members can request withdrawal from "BlueL" at any time, and "BlueL" will process the withdrawal immediately.
  2. If a member falls under any of the following reasons, "BlueL" may restrict or suspend membership:
    1. If false information was registered at the time of application
    2. If the member fails to pay for goods purchased through "BlueL" or other debts incurred in connection with the use of "BlueL"
    3. If the member interferes with others' use of "BlueL" or steals information, thereby threatening the order of electronic commerce
    4. If the member uses "BlueL" to engage in activities prohibited by law or these Terms, or acts against public order and morals
  3. If the same act is repeated twice or more, or if the cause is not corrected within 30 days after membership is restricted or suspended, "BlueL" may terminate the membership.
  4. If "BlueL" terminates membership, the registration will be canceled. In this case, the member will be notified and given at least 30 days to explain before the registration is canceled.
Article 8 Notification to Members
  1. When "BlueL" notifies a member, it can be done through the email address specified by the member in advance with "BlueL".
  2. For notification to an unspecified number of members, "BlueL" may substitute individual notifications by posting them on the "BlueL" bulletin board for at least one week. However, matters that have a significant impact on the member's transactions will be notified individually.
Article 9 Purchase Application
  1. Users of "BlueL" apply for purchases through the following methods or similar methods on "BlueL", and "BlueL" must provide the following information clearly during the purchase application. However, if the user is a member, the application of items 2 to 4 may be excluded.
    1. Searching and selecting goods, etc.
    2. Entering name, address, phone number, email address (or mobile phone number), etc.
    3. Confirming the contents of the terms and conditions, services where the right of withdrawal is restricted, and costs such as delivery charges and installation fees.
    4. Agreeing to the terms and conditions and indicating confirmation or rejection of item 3 (e.g., mouse click)
    5. Applying for purchase of goods, etc. and confirming the application or agreeing to the confirmation from "BlueL".
    6. Selecting the payment method.
Article 10 Formation of Contract
  1. "BlueL" may not accept the purchase application as per Article 9 in the following cases. However, if a contract is made with a minor, it must be notified that the minor or their legal representative can cancel the contract if the legal representative's consent is not obtained.
    1. If there is false information, missing details, or errors in the application.
    2. If a minor applies to purchase goods or services prohibited by the Youth Protection Act such as tobacco or alcohol.
    3. If accepting the purchase application is significantly impeded by "BlueL" technology.
  2. The contract is considered to be formed when the acceptance from "BlueL" reaches the user in the form of a confirmation notice as specified in Article 12, Paragraph 1.
  3. The statement of acceptance from "BlueL" must include information about the user's purchase application, the availability of sale, and the correction or cancellation of the purchase application.
Article 11 Payment Method
  1. The payment methods for goods or services purchased on "BlueL" can be done through any of the following methods. However, "BlueL" cannot impose any additional fees on the price of the goods or services based on the payment method chosen by the user.
    1. Various account transfers such as phone banking, internet banking, and mail banking
    2. Payment by prepaid cards, debit cards, and credit cards
    3. Online bank transfer
    4. Payment by electronic money
    5. Payment upon receipt
    6. Payment by points provided by "BlueL"
    7. Payment by gift certificates contracted with or recognized by "BlueL"
    8. Other electronic payment methods
Article 12 Confirmation Notice, Modification, and Cancellation of Purchase Application
  1. When there is a purchase application from a user, "BlueL" sends a confirmation notice to the user.
  2. Upon receiving the confirmation notice, the user can request the modification or cancellation of the purchase application immediately if there is a discrepancy in the statement of intention. If there is a request from the user before shipping, "BlueL" must process the request without delay. However, if the payment has already been made, the regulations on withdrawal of subscription in Article 15 shall apply.
Article 13 Supply of Goods, etc.
  1. Unless there is a separate agreement with the user on the supply period of goods, "BlueL" takes necessary measures such as order production and packaging within 7 days from the date of the user's subscription. However, if "BlueL" has already received all or part of the payment for the goods, it will take measures within 2 business days from the date of receiving the payment. At this time, "BlueL" must take appropriate measures to allow users to check the supply procedures and progress of the goods.
  2. "BlueL" specifies the means of delivery, the bearer of delivery costs for each means, and the delivery period for the goods purchased by the user. If "BlueL" exceeds the agreed delivery period, it must compensate the user for the resulting damage. However, this does not apply if "BlueL" proves that there was no intention or negligence.
Article 14 Refund
  1. If "BlueL" cannot deliver or provide the goods due to reasons such as out of stock, it will notify the user without delay and, if payment was received in advance, refund the payment or take necessary measures for refund within 2 business days from the date of receipt.
Article 15 Withdrawal of Subscription, etc.
  1. Users who have entered into a contract for the purchase of goods with "BlueL" can withdraw their subscription within 7 days from the date of receiving the confirmation notice.
  2. If the user has received the goods, they cannot return or exchange them in the following cases:
    1. If the goods are lost or damaged due to reasons attributable to the user (However, the subscription can be withdrawn if the packaging is damaged to check the contents of the goods)
    2. If the value of the goods has significantly decreased due to the user's use or partial consumption
    3. If the value of the goods has significantly decreased to the extent that resale is difficult due to the passage of time
    4. If the packaging of the goods that can be reproduced into goods with the same performance is damaged
  3. In the cases of items 2 through 4 in Paragraph 2, if "BlueL" has not specified in advance that the withdrawal of subscription is restricted, or if it has not taken measures to provide trial products, the user's withdrawal of subscription is not restricted.
  4. Notwithstanding Paragraphs 1 and 2, if the goods are different from the display or advertisement contents or are not performed as per the contract, the user can withdraw the subscription within 3 months from the date of receiving the goods, or within 30 days from the date of knowing or being able to know the fact.
Article 16 Effects of Withdrawal of Subscription, etc.
  1. When "BlueL" receives the return of goods from the user, it refunds the payment within 3 business days. If "BlueL" delays the refund to the user, it must pay interest calculated by applying the delay interest rate prescribed and announced by the Fair Trade Commission to the delay period.
  2. When "BlueL" refunds the payment, if the user paid for the goods with a credit card or electronic money, it must immediately request the business that provided the payment method to stop or cancel the payment claim for the goods.
  3. In the case of withdrawal of subscription, the user bears the cost necessary for returning the goods. "BlueL" does not claim any penalty or damage compensation from the user for the withdrawal of subscription. However, if the contents of the goods are different from the display or advertisement contents or are not performed as per the contract, "BlueL" bears the cost necessary for returning the goods.
  4. If the user bore the delivery cost when receiving the goods, "BlueL" clearly indicates who bears the cost at the time of withdrawal of subscription.
Article 17 Protection of Personal Information
  1. "BlueL" collects the minimum information necessary to fulfill the purchase contract when collecting user information. The following items are mandatory, and other items are optional:
    1. Name
    2. Address
    3. Phone number
    4. Desired ID (for members)
    5. Password (for members)
    6. Email address (or mobile phone number)
  2. When "BlueL" collects personal information that can identify an individual, it must obtain the user's consent.
  3. The provided personal information cannot be used for purposes other than its intended purpose or provided to third parties without the user's consent, and "BlueL" bears all responsibility for this. However, the following cases are exceptions:
    1. If necessary, minimum user information (name, address, phone number) is provided to delivery companies for delivery purposes.
    2. If provided in a form that cannot identify specific individuals for statistical purposes, academic research, or market research.
    3. If necessary for payment processing related to transactions.
    4. If necessary for identity verification to prevent fraud.
    5. If required by law or unavoidable reasons under the law.
  4. When "BlueL" needs to obtain the user's consent as per Paragraphs 2 and 3, it must specify or notify in advance the identity of the personal information manager (affiliation, name, phone number, other contact details), the purpose of collecting and using the information, the details regarding the provision of information to third parties (recipients, purpose, and details of the provided information), as stipulated in Article 22, Paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., and the user can withdraw this consent at any time.
  5. The user can request to view and correct errors in their personal information held by "BlueL" at any time, and "BlueL" must take necessary measures without delay. If the user requests error correction, "BlueL" will not use the personal information until the error is corrected.
  6. "BlueL" limits the number of managers to minimize the protection of personal information and bears all responsibility for any damage caused to the user due to loss, theft, leakage, or alteration of the user's personal information, including credit card and bank account details.
  7. When the purpose of collecting or providing personal information is achieved, "BlueL" or the third party who received the personal information must destroy the personal information without delay.
Article 18 Obligations of "BlueL"
  1. "BlueL" must not engage in any acts prohibited by law or these terms and conditions, and must strive to provide continuous and stable goods and services as specified in these terms and conditions.
  2. "BlueL" must have a security system in place to protect users' personal information (including credit information) so that users can use internet services safely.
  3. If "BlueL" engages in unfair labeling or advertising activities as stipulated in Article 3 of the Act on Fair Labeling and Advertising and causes damage to users, it is liable for compensation.
  4. "BlueL" will not send commercial advertising emails that users do not want to receive.
Article 19 Obligations of Members Regarding ID and Password
  1. Except as stipulated in Article 17, the management responsibility of ID and password lies with the member.
  2. Members must not allow third parties to use their ID and password.
  3. If a member's ID and password are stolen or if they recognize that a third party is using them, they must immediately notify "BlueL" and follow the guidance provided by "BlueL".
Article 20 User Obligations
  1. Users must not engage in the following actions:
    1. Registering false information during application or changes
    2. Stealing someone else's information
    3. Changing information posted on "BlueL"
    4. Transmitting or posting information other than the information set by "BlueL" (such as computer programs)
    5. Infringing on "BlueL" or third party's copyrights and other intellectual property rights
    6. Damaging the reputation of "BlueL" or third parties or interfering with their work
    7. Publicly posting or transmitting obscene or violent messages, images, voices, or other information that violates public order and morals
Article 21 Relationship Between Linked "BlueL" and Subordinate "BlueL"
  1. When a higher-level "BlueL" and a lower-level "BlueL" are connected by hyperlinks (such as hyperlinks include text, pictures, and moving images), the former is called the connecting "BlueL" (website), and the latter is called the subordinate "BlueL" (website).
  2. The connecting "BlueL" does not take responsibility for guaranteeing transactions conducted independently by the subordinate "BlueL" for goods, etc., provided that the connecting "BlueL" clearly indicates on the initial screen or at the time of connection that it does not guarantee the transaction.
Article 22 Attribution of Copyrights and Restrictions on Use
  1. The copyrights and other intellectual property rights of works created by "BlueL" belong to "BlueL".
  2. Users must not use information obtained by using "BlueL" that belongs to "BlueL" for commercial purposes or let third parties use it without prior consent from "BlueL".
  3. If "BlueL" uses the copyrights belonging to the user according to an agreement, it must notify the user.
Article 23 Dispute Resolution
  1. "BlueL" establishes and operates a damage compensation processing mechanism to reflect legitimate opinions or complaints raised by users and to compensate for the damage.
  2. "BlueL" prioritizes handling complaints and opinions submitted by users. However, if prompt processing is difficult, it will immediately notify the user of the reasons and the processing schedule.
  3. If a user applies for damage relief regarding electronic commerce disputes between "BlueL" and the user, it may follow the mediation of a dispute resolution agency commissioned by the Fair Trade Commission or the mayor/governor.
Article 24 Jurisdiction and Governing Law
  1. Lawsuits regarding electronic commerce disputes between "BlueL" and users are governed by the user's address at the time of filing, and if there is no address, by the jurisdiction of the district court that has jurisdiction over the place of residence. However, if the user's address or place of residence is unclear at the time of filing, or if the user resides abroad, the lawsuit will be filed with the competent court under the Civil Procedure Act.
  2. Korean law applies to electronic commerce lawsuits filed between "BlueL" and users.

Supplementary Provisions (Effective Date) These terms and conditions will be effective from March 8, 2024.
